TERMS OF SERVICE
By accessing and using scantrueai.com (hereinafter, "the Platform"), you acknowledge that you have read, understood, and agreed to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and ScanTrue AI.

II. User Accounts & Security
To access certain features, you must create an account. You are solely responsible for maintaining the confidentiality of your credentials. ScanTrue AI will not be liable for any loss or damage arising from your failure to protect your login information. Any activity performed under your account is attributed to you.
III. Payments, Credits & Refund Policy
3.1 Consumption of Digital Goods
Our forensic analysis involves the immediate allocation of high-cost neural computing resources and GPU clusters.
3.2 Transparent Refund & Fair-Use Policy
ScanTrue AI operates on a principle of equitable resource allocation. We recognize that users must ensure the Platform aligns with their operational needs. Therefore, if you purchase credits or a subscription and your account reflects a computational utilization of five percent (5%) or less of your acquired quota, you are entitled to a full, unconditional refund within fourteen (14) days of the transaction.
However, because our forensic architecture instantaneously provisions unrecoverable, high-cost neural computing clusters, you expressly acknowledge and agree that once your utilization exceeds the 5% threshold, the service is deemed fully and irrevocably rendered. Beyond this threshold, all rights to withdrawal or refund are categorically waived under applicable digital goods regulations.
3.3 Fraudulent Chargebacks
Initiating an unjustified chargeback through Stripe or your financial institution without first seeking resolution via our support will result in the permanent blacklisting of your identity and IP from our infrastructure. We will provide this signed agreement to your bank as evidence of service delivery.
IV. Prohibited Uses
Users are strictly prohibited from using the Platform to:
- ▹ Process illegal, non-consensual, or sexually explicit material.
- ▹ Reverse-engineer, decompile, or attempt to extract the source code or neural weights of our forensic models.
- ▹ Automate scanning through unauthorized bots or scraping methods.
- ▹ Resell forensic reports as a standalone service without a prior commercial license from ScanTrue AI.
V. Indemnification
You agree to indemnify, defend, and hold harmless ScanTrue AI and its employees from any claims, damages, or legal fees resulting from your use of the platform. You guarantee that you hold the legal rights to every file you upload for analysis. If a third party sues ScanTrue AI due to your activity, you will assume all costs and liabilities.
VI. Forensic Capabilities & Disclaimer of Warranties ("AS IS" Provision)
ScanTrue AI deploys enterprise-grade, state-of-the-art cryptographic and heuristic modeling designed to provide the highest echelon of digital asset verification available in the private sector. Nevertheless, artificial intelligence inherently operates on probabilistic vectors and statistical thresholds.
To the maximum extent permitted by applicable law, the Platform and all forensic deliverables are provided strictly on an "AS IS" and "AS AVAILABLE" basis. ScanTrue AI expressly disclaims all warranties, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular legal purpose, and non-infringement. We do not warrant that the Platform will be entirely error-free or impervious to novel, undocumented cyber threats.
ScanTrue AI acts exclusively as an advanced analytical instrument, not as a definitive judicial arbiter. You retain sole and exclusive legal liability for the introduction, interpretation, and admissibility of our algorithmic indicators within any legal, financial, or corporate proceedings.
VII. Data Privacy & Zero-Retention
Under our Zero-Retention Policy, files are processed in volatile memory and purged immediately after analysis. We do not store original evidence files. By using the platform, you acknowledge that once an analysis is closed, the data is unrecoverable by ScanTrue AI.
VIII. Service Availability
We strive for 99.9% uptime. However, ScanTrue AI is not liable for service interruptions caused by Force Majeure, maintenance, or failures in third-party providers (Hosting, API, or GPU clusters). We reserve the right to modify or discontinue any feature at our discretion.
IX. Intellectual Property
All content, algorithms, methodologies, and visual designs on this Platform are the exclusive property of ScanTrue AI. The issuance of a forensic report grants the user a license to use that specific document, but does not transfer any rights over the underlying technology.
X. Modifications to Terms
ScanTrue AI reserves the right to update these Terms at any time. Continued use of the Platform following any changes constitutes your acceptance of the new Terms. We recommend checking this page periodically.
XI. Jurisdiction
These Terms shall be governed by international digital trade laws. Any legal disputes shall be settled exclusively in the competent courts of the jurisdiction where the Platform owner is established.
XII. Dispute Resolution & Class Action Waiver
12.1 Mandatory Informal Arbitration
ScanTrue AI is deeply committed to resolving commercial discrepancies amicably and transparently. Prior to the initiation of any formal legal proceedings, both parties mutually agree to enter a mandatory thirty (30) day informal negotiation period, initiated via written notice to our designated legal department or Support Desk.
12.2 Class Action Waiver
You expressly and irrevocably agree that any claims instituted against ScanTrue AI must be brought exclusively in your individual corporate or personal capacity. You unequivocally waive any right to participate as a plaintiff or class member in any purported class action, consolidated litigation, or representative proceeding.
12.3 Binding Arbitration
Should informal resolution exhaust without accord, all irreconcilable disputes shall be submitted to binding, confidential individual arbitration, explicitly precluding public courtroom litigation, to protect the operational security and intellectual property of both parties.
XIII. Limitation of Liability and Damages Cap
This provision reflects a fundamental allocation of risk essential to this agreement. To the fullest extent permitted by international law, under no circumstances shall ScanTrue AI, its subsidiaries, directors, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages. This absolute exclusion applies to loss of profits, data corruption, reputational harm, or strategic business interruptions arising from the deployment or inability to utilize the Platform, regardless of the legal theory asserted (contract, tort, negligence, or strict liability).
Notwithstanding any contrary provision herein, ScanTrue AI’s total aggregate liability for any and all claims shall be strictly capped at the exact monetary amount remitted by you to ScanTrue AI during the twelve (12) consecutive months immediately preceding the event giving rise to the claim. For users utilizing the Free Tier, such liability shall not exceed the nominal sum of one hundred U.S. dollars ($100.00 USD).
XIV. API Fair Use and Infrastructure Defense
As a custodian of critical security infrastructure, ScanTrue AI enforces rigorous traffic monitoring to guarantee maximum uptime. We reserve the absolute and non-negotiable right to rate-limit (throttle), suspend, or permanently revoke API and UI access—without prior notice or liability—should we detect anomalous usage vectors, automated scraping, DDoS signatures, or reverse-engineering efforts that threaten our neural network clusters.
XV. Trade Compliance and Global Sanctions
By deploying the ScanTrue AI framework, you establish a legal warranty that you are not situated in, controlled by, nor a national or resident of any jurisdiction subject to comprehensive government embargoes (including, but not limited to, the United States, European Union, or United Nations). Furthermore, you certify that you are not designated on any restricted entity list (e.g., OFAC). The diversion of our forensic technology to sanctioned state or non-state actors constitutes a material breach of this contract and international law.
XVI. Severability and Entire Agreement
If any provision of these Terms of Service is determined by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such determination shall not impair or affect the validity, legality, or enforceability of the remaining provisions. The invalid provision shall be construed, or severed if necessary, in a manner that reflects the original intent of the parties as closely as permitted by law. These Terms constitute the entire and exclusive master agreement between you and ScanTrue AI regarding the Platform, superseding all prior contemporaneous oral or written agreements.
